I-94フォームの訂正について

   Ｑ： 米国入国時に、空港の入国審査で記入されたＩ−９４（出入国管理カード）の有効期限日に間違いを発見しました。どの用に対処したらいいのでしょうか。どこかで書き直してもらうことができますか。


Ａ： Ｉ−９４は非移民ビザ保持者にとって、米国に合法的に滞在する上ではたいへん重要なものです。米国に入国する飛行機の機内で記入する用紙で、その半券をＵＳＣＩＳ（ＵＳ・Citizenship and Immigration Services）が保持し、残りは入国者のパスポートにホチキスで止められます。皆さん、あまり気にしてないかも知れませんが、このＩ−９４こそが米国での滞在許可書なんです。滞在できる期日が空港で審査官によって入国時に手書きで書き込まれます。滞在許可期日はビザの種類によって異なります。例えばＥビザの場合、ビザの有効期限は５年ですが、Ｉ−９４に記される期間は通常の場合は２年です。例外として学生ビザ（Ｆ１）などの場合は、Ｉ−２０にある期日が滞在期間の決め手となりますので、Ｉ−９４には「Ｄ/Ｓ（Duration of Status）」と記されます。　


例えば、本来なら２００５年９月まで滞在できるのに、２００４年９月と記入されていたというような間違いも、入国管理の審査官が手書きで記入するので、実際には頻繁に起きています。このような間違えが起こった場合、これまでは、それを訂正するには、米国へ最初に入国して入国審査を受けた空港（例えばデトロイトで入国したらデトロイトの空港）または管轄の移民局まで出向くなどして訂正の手続きを求めていましたが、訂正を認めないケースもありました。

９・１１（同時多発テロ）以前はINS職員による入国管理が行われていましたが、現在はＣＢＰ（Customs and border protection）の職員が行っています。　ＣＢＰの管轄になってからは、どこで訂正できるのか明確ではありませんでした。しかし、最近のＵＳＣＩＳからの通達では、ＣＢＰにより、名前、生年月日、ビザの種類、滞在期限日などの明らかな記入ミスについては、本人が現在住んでいる地域近くのＣＢＰオフィスもしくはは空港で受け付けるという発表がありました。ただし、それら訂正の手続きは郵送では受け付けないので、注意が必要です。
